Nisorave Terms of Service

These Terms of Service (the "Terms") form a legally binding agreement between you and Nisorave Team ("Nisorave", "we", "us", or "our") governing your access to and use of the Nisorave mobile application and related services (collectively, the "Service").

2) Eligibility (17+)

The Service is intended only for users aged 17 or older. By using the Service, you represent that you are at least 17 years old and that you have the legal capacity to enter into these Terms.

3) Description of the Service

Nisorave helps you capture and organize your perfume journey, including:

• Create structured perfume profiles (e.g., brand, fragrance notes, images).
• Document scent inspiration and personal notes.
• Compare fragrances side-by-side to curate your collection.
• Personalize entries with photos and details.

4) Account Registration and Security

You may need to create an account to use certain features. You agree to:

• provide accurate and up-to-date information (such as name/username/email),
• maintain the security of your account credentials,
• promptly notify us if you suspect unauthorized access.

You are responsible for activities that occur under your account.

5) Your Content

5.1 Ownership

You retain ownership of the content you create, upload, or store in the Service, such as perfume profiles, notes, and photos ("User Content").

5.2 License You Grant Us

To operate the Service, you grant Nisorave a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display your User Content solely to provide and maintain the Service for you, prevent or address technical or security issues, and respond to your support requests.

This license ends when your User Content is deleted from the Service, except to the extent we must retain it for legal or security purposes.

5.3 Responsibility for User Content

You are responsible for your User Content. You agree not to upload or store content that violates law or others' rights.

6) Acceptable Use

You agree not to:

• use the Service for unlawful purposes,
• attempt to access others' accounts or data,
• interfere with or disrupt the Service (including through viruses or abusive traffic),
• reverse engineer, decompile, or attempt to extract source code except where prohibited by law,
• scrape, copy, or mass-export data from the Service in a way that harms the Service or other users.

7) Photos and Faces

• Nisorave does not perform facial recognition and does not attempt to derive biometric identifiers from photos.
• We do not use your User Content for advertising/marketing purposes or to train models for third-party use.

8) Privacy

Our handling of personal information is described in our Privacy Policy, which is provided separately from these Terms.

9) Intellectual Property

The Service, including its software, design, and trademarks, is owned by Nisorave or its licensors and is protected by applicable intellectual property laws. Except for the limited rights expressly granted to you, no rights are granted.

10) Feedback

If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation, provided we do not use your feedback in a way that identifies you without your permission.

11) Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we reasonably believe your use poses a security, legal, or operational risk.

Data handling after termination is governed by our retention practices described in the Privacy Policy.

12) Disclaimers

The Service is provided "as is" and "as available."

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nisorave is a personal organization tool; fragrance-related information is for informational purposes only.

13) Limitation of Liability

To the maximum extent permitted by law, Nisorave will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, Nisorave's total liability for any claim will not exceed the amount you paid (if any) to use the Service in the 12 months before the event giving rise to the claim.

14) Indemnity

You agree to indemnify and hold harmless Nisorave from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

15) Governing Law

These Terms are governed by the laws of Nisorave Team's principal place of business, excluding conflict-of-law rules, unless applicable law requires otherwise.

16) Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration rather than in court, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.

Unless the parties agree otherwise, arbitration will be conducted by a single arbitrator, in English, in the jurisdiction of Nisorave Team's principal place of business (or by remote means where appropriate), using procedures that allow a fair resolution of the dispute.

Where permitted by law, you and Nisorave waive any right to a jury trial and to participate in a class action or class-wide arbitration.

17) Changes to These Terms

We may update these Terms from time to time. The updated Terms will be effective as of the posted "Effective Date." Your continued use of the Service after the effective date means you accept the updated Terms to the extent permitted by law.
